Terms of sale
These Terms and Conditions of Sale apply to sales of products by SAS Lutèce to consumers through its website. Placing an order constitutes full acceptance of these terms.
The products offered are physical products sold from standard stock. Images and descriptions are provided for information purposes.
Orders are placed exclusively on the website. Confirming an order constitutes binding acceptance and an electronic signature. SAS Lutèce reserves the right to refuse an order in the event of a previous dispute or suspected fraud.
Prices are stated in euros, inclusive of all taxes, and are those in force on the order date.
Deliveries are handled by La Poste. Delivery times are estimates and do not give rise to liability on the part of SAS Lutèce.
In accordance with the law, customers have 14 days from receipt to exercise their right of withdrawal. Return costs are borne by the customer. Products must be returned new, unworn and in their original packaging.
Where the right of withdrawal has been exercised in accordance with these conditions, refunds cover the product price only and are made within the statutory period after receipt of the return.
The liability of SAS Lutèce is limited to direct damage.
Consumers have two years from delivery of the goods to invoke the statutory guarantee of conformity if a lack of conformity appears. During this period, consumers need only establish the existence of the lack of conformity, rather than the date on which it appeared.
Where the contract for the sale of goods provides for the continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that digital content or service throughout the agreed supply period. During this period, consumers need only establish the existence of the lack of conformity affecting the digital content or service, rather than the date on which it appeared.
The statutory guarantee of conformity requires the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory guarantee of conformity entitles consumers to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience.
If the goods are repaired under the statutory guarantee of conformity, consumers benefit from a six-month extension of the original guarantee.
If consumers request a repair but the seller requires replacement instead, the statutory guarantee of conformity is renewed for two years from the replacement date.
Consumers may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and receive a full refund upon returning the goods, if:
1. The trader refuses to repair or replace the goods;
2. The repair or replacement takes more than thirty days;
3. The repair or replacement causes significant inconvenience to the consumer, particularly where the consumer ultimately bears the costs of collecting or removing the non-conforming goods, or the costs of installing the repaired or replacement goods;
4. The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.
Consumers are also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that an immediate price reduction or termination is justified. In that case, consumers are not required to request repair or replacement first.
Consumers are not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.
The rights above arise from Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who, in bad faith, obstructs the implementation of the statutory guarantee of conformity may incur a civil fine of up to EUR 300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
Consumers also benefit from the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This warranty entitles consumers to a price reduction if they keep the goods, or a full refund upon returning them.
Damage caused by an accident, excessive pulling or misuse is not covered when it does not result from a lack of conformity or a hidden defect in the product.

All elements of the website and the products are the exclusive property of SAS Lutèce. Unauthorised reproduction or use is prohibited.
Personal data is processed in accordance with the Data Protection Policy available on the website. The other policies supplement these Terms and Conditions of Sale.
These terms are governed by French law. In the event of a dispute, the courts of Paris have jurisdiction, subject to the statutory provisions applicable to consumers.
